Terms of Service

These Terms of Service ("Terms") govern your use of the Kept — Curated Collections iOS app, our website at https://kept-collections.com, and related services (collectively, the "Services"), operated by Thad Hull, doing business as Kept — Curated Collections ("Kept," "we," "us," or "our"), a sole proprietorship based in Columbus, Georgia, United States.

Please read these Terms carefully. By downloading, installing, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Description of service

Kept is a mobile application that helps users scan, identify, catalog, and value collectible items using artificial intelligence. The Services include:

• AI-powered identification of collectibles across more than 30 categories (sports cards, coins, stamps, trading card games, vintage toys, jewelry, vinyl, and more).
• AI-generated value estimates including market value, selling price, and insurance replacement value.
• Collection organization tools (collections, photos, notes, location tracking, search, sort, and filtering).
• Free anonymous use with a 10-scan limit, plus optional account-based features and paid subscription tiers offering higher scan limits and additional features.
• Cloud sync (free for all signed-in users), photo storage, PDF estate-summary export, and CSV export.

We may add, modify, or remove features over time. We will notify you of material changes that affect your subscription or core functionality.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to enter into these Terms and use the Services. By using the Services, you represent that you meet this requirement.

The Kept app is rated 4+ for content suitability, meaning the app itself does not contain content unsuitable for younger users. However, because these Terms form a binding legal contract, you must be at least 18 to agree to them. Users under 18 may use Kept only with the involvement and supervision of a parent or legal guardian who agrees to these Terms on their behalf.

Kept is not intended for and may not be used by children under 13. If we become aware that a user is under 13, we will delete their account and associated data. See our Privacy Policy for more on children's privacy.

You may not use the Services if you are located in a country subject to U.S. government embargo or designated as a "terrorist supporting" country, or if you are listed on any U.S. government list of prohibited or restricted parties.

3. Your account

Anonymous use of Kept does not require an account. If you choose to sign in:

• You may create an account using email and password, or Sign in with Apple.
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• You agree to provide accurate and current information when creating an account.
• You may delete your account at any time via Settings → Delete Account. Once confirmed, your account and all associated data are permanently removed from our systems within 30 days, in accordance with Apple App Store Guideline 5.1.1(v).
• We may suspend or terminate your account if you violate these Terms or use the Services in a way that harms Kept, other users, or third parties.

4. Subscriptions and in-app purchases

Kept offers two paid subscription tiers, in addition to a free tier:

Subscriptions purchased through the iOS app are processed by Apple via the App Store. Web-based pricing, if available, may differ and is processed through our payment processor (Stripe). Cloud sync is included free with any account, regardless of subscription status.

Auto-renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage your subscription and turn off auto-renewal by going to your Apple ID settings (Settings → Apple ID → Subscriptions on your device) at any time after purchase.

Cancellation and refunds

You may cancel your subscription at any time via Settings → Apple ID → Subscriptions on your device. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then. Subscriptions do not provide refunds for partial periods.

Refunds are handled by Apple, not by Kept. To request a refund, follow Apple's process at https://reportaproblem.apple.com. We do not have the ability to issue refunds for App Store purchases.

Billing changes and price increases

We may change subscription prices or terms with at least 30 days' notice. If a price increase applies to your existing subscription, you will be notified in advance and may cancel before the change takes effect to avoid being charged the new price.

Restore purchases

If you reinstall Kept or switch devices, you can restore your active subscription via Settings → Restore Purchases. Active subscriptions tied to your Apple ID will be recognized automatically.

5. AI-generated valuations — important disclaimer

Kept uses artificial intelligence (currently OpenAI's GPT-5.4 model, accessed via our secure backend proxy) to identify items and generate value estimates. These valuations are estimates only and are not professional appraisals.

By using Kept, you acknowledge and agree that:

• AI-generated identifications and valuations may be inaccurate, incomplete, outdated, or wrong.
• Value estimates currently rely on AI judgment rather than real-time market data (real market pricing is planned for a future release and clearly labeled when available).
• The three value tiers shown (market value, selling price, insurance replacement value) are starting points for your own research, not definitive figures.
• You should not rely on Kept's valuations alone for insurance coverage decisions, estate planning, tax filings, sale negotiations, or any other financial or legal purpose.
• For any decision with significant financial consequences, consult a qualified professional appraiser, certified dealer, insurance adjuster, or attorney.

We make no representation or warranty regarding the accuracy, completeness, or reliability of any AI-generated identification or valuation.

6. Acceptable use

You agree to use the Services only for lawful, personal purposes. You agree NOT to:

• Use the Services to scan, identify, or catalog items that are illegal to own, sell, or transport under applicable law (including controlled substances, federally regulated weapons, ivory or other prohibited wildlife products, or stolen goods).
• Scan images that you do not own or have permission to upload (such as copyrighted product photography you found online), or use Kept to facilitate copyright infringement.
• Use Kept's valuations to deliberately misrepresent items to buyers, insurers, tax authorities, or other third parties.
• Attempt to reverse-engineer, decompile, or otherwise extract source code, AI models, or proprietary logic from the Services.
• Interfere with or disrupt the Services, our servers, or the experience of other users (including by sending automated requests at high volume, attempting to bypass rate limits, or probing for security vulnerabilities without authorization).
• Use the Services to build, train, or evaluate a competing AI model or product.
• Resell, sublicense, or commercially redistribute the Services without our prior written consent.

We may suspend or terminate accounts that violate these rules.

7. User content and license

When you save scans, photos, notes, and other content in Kept, you retain ownership of that content ("User Content").

If you sign in and your data syncs to our cloud (Supabase), you grant Kept a limited, non-exclusive, worldwide, royalty-free license to store, copy, transmit, display, and process your User Content solely as needed to provide the Services to you. This license ends when you delete the content or your account.

You represent and warrant that you have the rights to all User Content you upload and that it does not violate the rights of any third party.

We do not claim ownership of your User Content and will not use it for advertising, training third-party AI models, or any commercial purpose beyond operating Kept.

8. Intellectual property

The Services, including the Kept app, the Kept name and logo, website, design, code, AI prompts, and all related materials, are owned by Thad Hull and protected by United States and international copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved.

9. Third-party services

Kept integrates with several third-party services to operate, including OpenAI, Apple, Supabase, RevenueCat, Cloudflare, Loops, and Sentry. Your use of Kept may also involve these services, and your interaction with them is governed by their respective terms and privacy policies (see our Privacy Policy for the full list and links).

We are not responsible for the availability, accuracy, or actions of third-party services. If a third-party service fails or changes its terms in a way that affects Kept, we will work to address the impact but cannot guarantee continuous availability.

10. Disclaimer of warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

• THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
• AI IDENTIFICATIONS, CATEGORIZATIONS, OR VALUATIONS WILL BE ACCURATE, RELIABLE, OR COMPLETE.
• THE RESULTS YOU OBTAIN FROM USING THE SERVICES WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEPT (AND ITS OWNER, AFFILIATES, AND CONTRACTORS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, LOST GOODWILL, OR REPLACEMENT COSTS — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGES ARISING FROM RELIANCE ON AI-GENERATED VALUATIONS FOR INSURANCE, ESTATE, SALE, TAX, OR OTHER PURPOSES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such cases, our liability is limited to the maximum extent permitted by applicable law.

12. Termination

You may stop using the Services at any time. You can delete your account via Settings → Delete Account in the app.

We may suspend or terminate your access to the Services, with or without notice, if you violate these Terms or use the Services in a way that harms Kept or others. Upon termination:

• Your right to use the Services ends immediately.
• We may delete your account and associated data (subject to legal retention requirements and our Privacy Policy).
• Subscription cancellation is handled through Apple per Section 4. We do not separately refund unused subscription time.
• Sections that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and governing law) will survive.

13. Apple-specific terms (for iOS App Store users)

You acknowledge and agree that:

• These Terms are between you and Kept only, and not with Apple. Apple is not responsible for the Services or their content.
• Scope of license. The license granted to you for Kept is limited to a non-transferable license to use Kept on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions.
• Maintenance and support. Kept is solely responsible for any maintenance and support services. Apple has no obligation to furnish any maintenance or support for the app.
• Warranties. In the event of any failure of Kept to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app (if any) to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Kept. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty will be Kept's sole responsibility.
• Product claims. Kept (not Apple) is responsible for addressing any user or third-party claims relating to the app, including but not limited to: (a) product liability claims, (b) any claim that the app fails to conform to any applicable legal or regulatory requirement, and (c) claims arising under consumer protection, privacy, or similar legislation.
• Intellectual property rights. In the event of any third-party claim that the app or your use of it infringes that third party's intellectual property rights, Kept (not Apple) will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Legal compliance. You represent and warrant that (a) you are not located in a country subject to a U.S. government embargo or that has been designated by the U.S. government as a "terrorist supporting" country, and (b) you are not listed on any U.S. government list of prohibited or restricted parties.
• Developer name and address for notices: Thad Hull, Columbus, Georgia, United States. Email: tj@kept-collections.com.
• Third-party terms. You agree to comply with all applicable third-party terms when using Kept (for example, your wireless data agreement when using cellular data).
• Third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

14. Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Kept and its owner from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Services in violation of these Terms, (b) User Content you upload that infringes the rights of any third party, or (c) your violation of any applicable law.

15. Governing law and dispute resolution

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law principles.

Before filing any formal legal action, you agree to first contact us at tj@kept-collections.com to attempt good-faith informal resolution. Most disputes can be resolved by email within a reasonable time.

If informal resolution fails, the federal and state courts located in Muscogee County, Georgia, shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to the personal jurisdiction of those courts.

16. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. For material changes, we will notify users via email (if you have an account) or by an in-app notice at least 30 days before the change takes effect, where reasonably possible.

Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you may delete your account and stop using the Services before the effective date.

17. Miscellaneous

• Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kept regarding the Services.
• Severability. If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect.
• No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets.
• No third-party beneficiaries, except as expressly stated for Apple in Section 13.
